The National Court has put an end to the case against the Israeli prime minister for the detention of a Spanish soldier in Lebanon. Judge Antonio Piña determined that, as there are active investigations within the UN and Israel, Spain does not have the jurisdiction to intervene in the case.

Judge Antonio Piña, of the National Court, has made a decisive ruling: the archiving of the complaint filed by the Iustitia Europa party against the Prime Minister of Israel, Benjamin Netanyahu.

The conflict originated in April 2026, when a Spanish soldier belonging to UNIFIL (United Nations Interim Force in Lebanon) was intercepted and illegally detained by the Israeli army in southern Lebanon.

The core of the conflict: It was being investigated whether the detention of the "blue helmet" constituted a crime that could be judged under Spanish jurisdiction.

However, the judicial resolution was based on the principle of subsidiarity. After consulting with international organizations, it was confirmed that there are ongoing processes that invalidate the opening of a case in Spain.

Investigating Entity Status of the Process Reason for Archiving
UN Active internal investigation Avoids jurisdictional duplication
Israel Active internal investigation Compliance with the LOPJ

The Prosecution was clear in pointing out that there is no evidence that these investigations are ineffective. Under this scenario, the judge applied Article 23.5 of the Organic Law of the Judiciary, which prevents the Spanish justice system from acting on crimes committed abroad if effective investigations are already underway in the countries involved.

  • Fact: Detention of a Spanish soldier in Lebanon (April 2026).
  • Accused: Benjamin Netanyahu.
  • Resolution: Definitive archiving of the complaint.
