Argentina Tightens Immigration Rules: New Decree Targets Hate Speech and Patriotism

A New Chapter in Argentina’s Migration Policy

In a bid to strengthen national sovereignty and democratic coexistence, President Javier Milei signed Decree 681/2026, published in the Official Gazette on July 30, 2026. The measure, effective July 31, 2026, amends Law 25.871 on Migration, updating articles 29, 62, and 63 to give the state more tools to protect national identity.

Background: The World Cup and National Identity

The initiative comes after the 2026 World Cup final, during which a supposed anti-Argentina campaign emerged on social media and international outlets, driven by celebrities such as Samuel L. Jackson, Rosalía, Niall Horan, and Arturo Pérez-Reverte. According to reports from La Nación and Infobae, presidential advisor Santiago Caputo and Security Minister Alejandra Monteoliva played key roles in designing and enabling the decree, which aims to respond to these hostile expressions with a firm and hopeful institutional stance.

What Does the New Decree Establish?

The DNU introduces new grounds for denying entry or canceling residency for foreigners who engage in conduct incompatible with respect for the nation. The new causes include:

  • Directing hate messages, orally or in writing, against the Argentine people or a citizen because of their nationality.
  • Inciting violence against the Argentine people or its citizens.
  • Carrying out or participating in acts of desecration of national patriotic symbols.
  • Inciting any of the above behaviors.

Protection of Free Speech

It is crucial to note that the regulation includes a specific clause to safeguard constitutional rights. The decree expressly states that expressions of ideological dissent or political, academic, and citizen criticism cannot be considered grounds for inadmissibility or expulsion. This ensures that democratic debate and plurality of ideas remain the pillars of Argentine society.

In the face of recent hostile manifestations against the Argentine Republic and Argentines, the National Government reaffirms that the defense of the Nation, its citizens, and its symbols is non-negotiable.

The National Directorate of Migration, under the Ministry of Security, will be responsible for applying these new criteria.
